Welcome to Click Courier! These Terms of Service ("Terms") govern your access to and use of Click Courier's website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. User Accounts
- Registration: To use certain features of the Service, you must register for an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current.
- Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. Click Courier cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
- User Roles: Accounts are assigned specific roles (Business, Courier, Admin) with different functionalities and responsibilities.
2. Service Description
Click Courier provides a platform connecting businesses needing delivery services with independent couriers. We facilitate the posting of delivery orders, assignment of couriers, tracking of packages, and processing of payments.
3. Strict Rules for Businesses
- Accurate Order Details: Businesses must provide precise and truthful information for all orders, including:
- Exact pickup and delivery addresses (street, house number, city/area).
- Accurate pickup and delivery contact names and phone numbers.
- Precise package weight (in kg) and dimensions (LxWxH cm).
- A clear and truthful description of package contents.
- Declaration of fragile items.
- Prohibited Items: Businesses are strictly prohibited from sending illegal, hazardous, dangerous, or restricted items (e.g., weapons, explosives, narcotics, live animals, perishable goods without proper packaging, valuable items like jewelry or large sums of cash unless explicitly pre-approved and insured). Non-compliance will result in immediate service termination and may lead to legal action.
- Appropriate Packaging: All packages must be securely and appropriately packed for transport. Click Courier reserves the right to refuse pickup if packaging is deemed insufficient or unsafe.
- Payment Obligations: Businesses must fulfill their payment obligations for orders as per the chosen payment method (Card, COD, EasyPaisa, JazzCash, COP). Failure to pay may result in suspension or termination of service.
- Cancellation Policy: Orders can be cancelled by the business if they are in 'Pending', 'Assigned', or 'Rejected by Courier' status. Once a courier marks an order as 'Picked Up' or 'In Transit', cancellation may not be possible without penalties, or at all.
- Legal Compliance: Businesses must ensure all goods being shipped comply with all applicable local, national, and international laws and regulations.
4. Strict Rules for Couriers
- Registration & Verification: Couriers must complete a thorough registration process, including:
- Providing accurate personal information, including a profile photo.
- Uploading valid, unexpired copies of National ID (CNIC/Passport), Driving License, Proof of Address (e.g., utility bill), and Vehicle Registration Document.
- Providing accurate Bank Account details for payouts.
- Providing two verifiable professional or personal references.
- Providing a valid emergency contact.
- Undergoing necessary background checks as determined by Click Courier. Falsification of documents or information will lead to immediate and permanent termination.
- Professional Conduct: Couriers must maintain a high level of professionalism, including:
- Punctuality: Arrive at pickup and delivery locations promptly.
- Safety: Adhere to all traffic laws and drive safely.
- Respectful Interaction: Treat businesses, recipients, and Click Courier staff with respect and courtesy.
- Appearance: Maintain a presentable appearance while on duty.
- Vehicle Maintenance: Couriers are responsible for ensuring their registered vehicle is roadworthy, well-maintained, and complies with all local vehicle regulations.
- Handling of Packages:
- Handle all packages with extreme care to prevent damage.
- Ensure packages are secured during transit.
- Do not open, inspect, or tamper with package contents.
- In case of suspicious packages, immediately contact Click Courier support and local authorities.
- Duty Status: Couriers must accurately reflect their 'On Duty' or 'Off Duty' status on the portal. Remaining 'On Duty' while unavailable for jobs may result in penalties.
- Accepting/Rejecting Jobs:
- Couriers are free to accept or reject jobs.
- Frequent rejection of jobs, especially after accepting them, may lead to account review or temporary suspension.
- Rejecting an *assigned* order after acceptance will incur a penalty of **20% of the order's price** from the courier's accumulated earnings to cover administrative costs and re-assignment efforts.
- Cash Handling (COD/COP): Couriers are responsible for accurately collecting and remitting cash for Cash on Delivery (COD) and Cash on Pickup (COP) orders. Any discrepancies will be investigated and may result in penalties or legal action.
- Legal Compliance: Couriers must comply with all traffic laws, local regulations, and any other applicable laws during the course of their duties.
5. How We Pay Couriers
Click Courier is committed to fair and transparent compensation for our couriers. Your earnings are calculated based on the following structure:
- Fixed Fee per Delivery: For every successfully completed delivery, couriers earn a fixed fee of PKR 50.
- Per-Kilometer Fee: In addition to the fixed fee, couriers earn PKR 15 for every kilometer of the estimated delivery distance for a completed order.
- Example Calculation: If an order has an estimated distance of 10 km, the courier's earning for that delivery would be: PKR 50 (fixed) + (10 km * PKR 15/km) = PKR 50 + PKR 150 = PKR 200.
Payout Process:
- Digital Payments (Card, EasyPaisa, JazzCash): For orders paid digitally by the business, your earnings (Fixed Fee + Per-Kilometer Fee) for that delivery are credited to your Click Courier in-app earnings balance immediately upon successful completion and marking the order as 'Delivered' in the Courier Portal.
- Cash on Delivery (COD) / Cash on Pickup (COP): For orders where cash is collected by the courier (COD or COP), your earnings (Fixed Fee + Per-Kilometer Fee) will be reflected in your pending earnings balance. These earnings will only be moved to your available balance and become eligible for withdrawal *after* the admin team has verified the cash collection and formally approved the payout for that specific order. This process ensures accurate reconciliation of cash.
Withdrawals and Deductions:
- Payout Cycle: Couriers can typically request payouts from their available earnings balance on a weekly or bi-weekly basis, as specified in the Courier Portal. Funds will be transferred to your registered bank account.
- Deductions/Penalties: As mentioned in Section 4 (Rules for Couriers), certain actions like rejecting an assigned order may result in a penalty deduction from your earnings. Any other service fees, charges for damages, or other deductions will be clearly communicated and reflected in your earnings statement.
- Earnings Transparency: Your Courier Portal Dashboard provides a real-time view of your total accumulated earnings, allowing you to track your compensation.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Click Courier and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Click Courier.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Click Courier makes no warranties, express or implied, regarding the operation of the Service or the information, content, materials, or products included on the Service.
8. Limitation of Liability
In no event shall Click Courier, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Indemnification
You agree to defend, indemnify, and hold harmless Click Courier and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
10. Governing Law & Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
